Disclaimer and Refund and Cancellation Policy

RELEASE OF LIABILTY AGREEMENT, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT BY AGREEING TO THE TERMS OF THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

PLEASE READ CAREFULLY!

In consideration of registration and participation in the this program, I hereby agree that I will:

  1. Assume all risks and irrevocably release and forever hold harmless and discharge ORFA Inc., and its officers, directors, employees, agents, contractors (including instructors), successors and assigns (collectively the "Releasees"), or any of them, of and from all manner of liability, actions, causes of action, suits, covenants, claims and demands whatsoever, both in law and in equity (the "Claims"), which the Registrant or their heirs, executors, administrators, successors or assigns, or any of them, now has or hereafter can, shall or may have against one or more of the Releasees for or by reason of any cause, matter or thing whatsoever relating to participation in the Program.
  2. Acknowledge that participation in the Program, including, without limitation, any and all travel, entails numerous risks, known and unknown, and potentially dangerous circumstances and conditions that may result in bodily, emotional and/or material damages. When identified as a specific Program requirement, that the Registrant acknowledges and agrees to supply the mandatory use of head protection and any/all other recommended ORFA Inc. or workplace required Personal Protective Equipment.
  3. Accepts that Program Releasees may use or request involvement from the Registrant to help demonstrate the safe operation of potentially dangerous machinery or tasks. As such, the Registrant agrees for their own personal safety to be attentive to the Releasees at all times. The Registrant further agree to express their direct or potential concern to the Program Releasees if they are not completely competent or comfortable to safely participate in any Program educational demonstration or training exercise. The Registrant must report to the Releasee the absence of or defect in any equipment or protective device which may endanger himself, herself or another registrant; or remove or make ineffective any protective device; or use or operate any equipment, machine, device or thing or work in a manner that may endanger himself, herself or any other Registrant; or engage in any prank, contest, feat of strength, unnecessary running or rough and boisterous conduct.
  4. Consent to the use of their name, likeness, image, and voice being interviewed, recorded, photographed, filmed and/or taped for education, advertising, publicity, commercial or other by the ORFA Inc. for business purposes and; hereby release the ORFA Inc. and; any of its associated or affiliated companies, their directors, officers, agents, employees and customers, and appointed advertising agencies from all claims of every kind on account of such use.
  5. Understand and accept the ORFA Inc. Program refund and cancellation policy which states that “a complete refund, less an administration fee, will be issued provided written notification of cancellation is received by the ORFA Inc. no later than 30 days prior to the commencement of the Program with no refunds being issued after this time period”. ORFA Inc. reserves the right to cancel any Program. In the event of a Program cancellation, any costs incurred. by registrants will not be the responsibility of the ORFA Inc. Registrants shall receive a full refund should the ORFA Inc. cancel any Program.
